Summary/Abstract: The notion of professional is the concept with the most ingrate position of the new commercial regulation. The Romanian Civil Code legislature created this notion only to emphasize the unity of private law. The legal clarification of the notion of professional is particularly important as the professional has several professional obligations, the freedom of trade is subject to economic and social restrictions, and in the event of litigation there are rules derogating from common law.
