Summary/Abstract: Regarding goods that belong either to the public domain of the state or to that of the administrative territorial units, it is necessary to fulfill the condition of acquiring the right of public ownership through one of the ways provided by law. In other words, the generic determination of the exclusive belonging to the public domain, by law or government decision, of a certain category of goods, which, by their nature, are of use or of public interest, cannot be understood in the sense of an infringement the right to private property. In order for the acquirer of a tabular right to be considered of good faith, several conditions must be met, namely: the real right entered in the land register must have been acquired through a legal act with onerous title, no action has been registered by which disputes the contents of the land register, there is no reason from the contents of the register to justify its rectification in favor of another person and he did not know, in any other way, the inaccuracy of the contents of the register.
