The impact of serving a prison sentence on the effectiveness of the convict’s social rehabilitation processes in the light of the changes to the Penal Code of October 1, 2023

Summary/Abstract: This article raises the issue of the impact of the execution of a prison sentence on the effectiveness of the convict’s social rehabilitation processes, focusing in particular on the changes made to the Penal Code of October 1, 2023. The problem was analyzed in terms of the impact of isolation on the inmate’s psyche and the occurrence of phenomena such as penal populism, the process of prisonization or depersonalization. The interpretation of the goals and functions of criminal punishment made it possible to find changes in the amendment to the Penal Code that would increase the severity of Polish penal law and make rehabilitation processes among prisoners more difficult. The article focuses, among others, on the increase in the limits of the statutory threat of punishment, changes in the conflict rules for the combination of grounds for extraordinary punishment, the prohibition of applying for early release by perpetrators sentenced to life imprisonment, and the extension of the probation period for conditional early release.
