Summary/Abstract: Legal, high-quality, efficient and purposeful behavior of officials and responsible persons in state bodies and legal entities in the performance of their entrusted public powers and official duties is the basis and guarantee for the functioning of public services and state bodies in general. From ancient times to the present day, there have been individuals and groups who, instead of working in the interest and on behalf of state bodies and public services on whose behalf they act, violated the rules of the service and thus committed abuses of various kinds. Abuse of official position or authority is a basic criminal offense against official duty for which a strict prison sentence is prescribed. The offense occurs in the form of abuse of official position or authority, in exceeding the limits of official authority or in failure to perform official duty. Depending on the intention of the perpetrator and the type of consequence caused, this criminal offense appears in three basic forms. The paper discusses the concept, elements, characteristics and forms of abuse of official position and authority. as the basic official criminal offense in the legal system of the Republic of Srpska.
