Summary/Abstract: Foreign nationals residing in Serbia for extended periods often seek access to rights and services, including establishing associations or businesses, but face significant challenges due to lack of identification documents from their home countries. While some categories, like asylum seekers or those with approved temporary residence, can obtain Serbian ID documents and access services, many migrants remain without legal status or identification, making them “legally invisible” and unable to engage in legal transactions. This situation raises the need for clearer regulations on temporary or tolerated stay to ensure legal identity, increase legal security, and facilitate access to rights and services.
