Summary/Abstract: After more than five years of intense migratory movements on the territory of the Republic of Serbia, it is increasingly happening that foreigners/migrants who have already submitted an asylum application once again try to do so after some time. Such a situation opened up a series of procedural issues that ultimately threaten to prevent access to international protection and further burden the asylum procedure: Can a seeker who has given up the initial request for asylum (either explicitly in writing or by indirect actions, such as leaving the center where he stayed or the Republic of Serbia in general without the knowledge of the Asylum Office) request again after several months or years to be granted the right to asylum in the Republic of Serbia? And if yes, which process institutes are at his disposal. Additionally, in the case of submitting a subsequent request, what is the subject of examination of the subsequent request procedure and to what extent does the finality of the decision to suspend the initial procedure affect the initiation of the subsequent asylum request procedure?
