Dreptul de autor face obiectul unor preocupări legislative relativ târziu, datorită, în special, absenţei mijlocului de reproducere în masă a operelor literare si artistice, cu toate că putem vorbi de recunoaşterea unui anume drept moral de paternitate în perioada antichităţii. Conceptele de „proprietate intelectuală” şi de „drepturi de autor” vor prinde contur la sfârşitul secolului al XVII-lea şi începutul secolului al XVIII-lea când încep să apară primele reglementări. Finalul secolului al XIX-lea dă startul acordurilor internaţionale cu privire la drepturile de autor influenţând semnificativ legislaţiile naţionale, pentru ca ultimii 120 de ani să arate o evoluţie spectaculoasă a domeniului.

Din perspectiva construirii şi valorificării colecţiilor şi bibliotecilor digitale, drepturile de proprietate intelectuală au în vedere rezolvarea problemelor de natură legală asociate cu accesarea, copierea şi diseminarea documentelor pe suport fizic şi digital. Aceste drepturi includ: drepturile proprietarului surselor materiale care sunt digitizate; drepturile proprietarului asupra resurselor digitizate; drepturile sau permisiunea garantată furnizorului de servicii de a face disponibilă resursa digitală; drepturile sau permisiunea garantată de utilizare a resurselor digitale. Resursele digitale sunt publicate pe site-uri web organizate sau nu în colecţii sau baze de date. În aceste cazuri, drepturile de proprietate intelectuală şi drepturile conexe au în vedere site-ul ca întreg, privit ca o creaţie originală; programele, aplicaţiile informatice integrate în prezentarea şi diseminarea resurselor digitale sau puse la dispoziţia utilizatorilor finali (licenţele informatice utilizate); conţinutul digital şi stabilirea reglementarilor juridice necesare între proprietarii de conţinut şi furnizorii de servicii.

There are many features shared by electronic and printed book. From the perspective of organizing and valorizing digital collections and libraries, the intellectual property rights take into consideration the legal aspects associated to access, copy and dissemination of documents both on physical and digital support. These rights include: the owner of the material resources to be digitized; the owner rights upon the digitized materials; the rights or the guaranteed permission to the services provider to make available the digital resources; the rights or the guaranteed permission to use the digital resources.The digital resources are published on websites organized or not in collections and databases. In these situations, the intellectual property rights and related rights take into consideration the website as a whole,regarded as an original creation; the software, the automation integrated applications in presenting and disseminating the digital resources or put at the disposal of the final users (the automation licences used); the digital content and the legal regulations necessary between the content owner and the services providers.

În economia cunoaşterii care vizează rolul copyrightului în diseminarea cunoaşterii pentru cercetare, ştiinţă si educaţie, dreptul de împrumut public reprezintă un mijloc adecvat de susţinere culturală şi economică a autorilor, în măsura în care bugetele alocate bibliotecilor nu sunt afectate. La aproape două decenii de la apariţia Directivei privind dreptul de închiriere şi de împrumut (Directiva92/100/CEE, din noiembrie 1992), o serie de State Membre nu au reuşit să implementeze prevederile acesteia. Articolul descrie apariţia si evoluţia sistemului PLR si încearcă să explice aspectele specifice într-un context mai amplu din punct de vedere istoric şi cultural. Controversele legate de dreptul de remuneraţie al autorilor este de asemenea descris, precum şi stadiul implementării directivei în România.

In a knowledge based economy, PLR is an usefull means of cultural, recognition and economic support for authors as long as is not coming from library bugets, but from the State budget, and libraries functionning as an trustful intermediary. Almost almost two decades after publication of the Council Directive 92/100/EEC on “Rental right and lending right and on certain rights related to copyright in the field of intellectual property” (in November 1992), there are a number of Member States still failing to implement it. This article describes the birth and development of the PLR system and seeks to explain its special features by putting it in the larger cultural historical context. The controversy concerning the right of non-fiction writers to receive compensation is also described, as well as the PLR situation in Romania.

Cartea electronică și cartea tipărită au multe trăsături în comun, însă si destule deosebiri. Biblioteca digitală si cea tradițională se aseamănă, dar se și diferențiază. Articolul nu redeschide dezbaterea despre suprapunerile, delimitările si viitorul acestor fapte culturale, ci explorează atitudinile față de ele. Cum le văd oamenii? Cât de diferit sunt ele percepute? The article doesn’t reopen the debate on the future of these entities, but explores the attitudes towards them. How do we see them? How different do they appear to people? Lucrarea propune un studiu despre impactul noului mediu informațional asupra utilizatorilor unei biblioteci universitare. Este primul studiu dedicat predominant resurselor electronice, care analizează folosirea anumitor servicii și resurse de informare și cercetare furnizate de către bibliotecă, și a bazelor de date online oferite, în relație cu profilul utilizatorilor. Analiza rezultatelor a evidențiat necesitatea proiectării și introducerii unui program pentru educația utilizatorilor, în ceea ce privește accesarea resurselor electronice, și a unui training referitor la metodele de căutare si de rafinare a documentelor pentru bibliotecarii care furnizează servicii de regăsire a informațiilor în resursele electronice; un marketing mai bun este, de asemenea, o opțiune adecvată. Condiția de a rămâne un competitor serios pe o piață concurențială a furnizării de informații este flexibilitatea si disponibilitatea de adaptare la nou; de asemenea, sunt necesare și competențe superioare în managementul documentelor de mare valoare stiințifică.

The paper proposes a research about the impact of the new informational environment on users of a university library. This is the first one dedicated mostly to electronic resources and it analyzes the use of certain services and resources of information and research provided by the library, and online databases offered in relation to the users’ profile. The results analysis highlighted the necessity of designing and implementing a program for the users’ education in terms of accessing e-library resources, and a regular training on all methods of searching and refining documents of librarians who provide information retrieval services of e-resources; a better marketing service is a good choice, too. The condition to remain a serious competitor in the competitive market of providing information is the flexibility and the readiness to adapt to novelty; enhanced competencies in management of high scientific value documents are also required.

Currently in Romania, the difficulties encountered by users with special reading needs, in terms of access to information and education, are obvious. The Paper aims to provide a panoramic view of the importance of their literacy through libraries. Another aspect that is approached is the role that the professionals that assist these special categories of users in its integration to the society play. The Romanian literary press in inter-war period recorded an impressive mobility, being represented by several literary, cultural magazines and newspapers who were able to reflect the literary life pulse during that period.
